A $7.5 million settlement obtained by an Austin personal injury law firm and the Falcon Law Group PLLC underscores the critical role of independent investigation in commercial vehicle accidents, particularly when large corporations control key electronic evidence. The case, resolved in May 2025, involved a client seriously injured in a highway collision with a vehicle operated by one of the nation's largest delivery companies.
According to the announcement, the crash was caused by a distracted delivery driver who missed a highway turn and abruptly braked, leading to a serious collision. For more than a year, the delivery company and its insurer maintained that the injured client was responsible. The firms' investigation, which included collecting electronic evidence and deposing key witnesses, challenged that narrative.
A pivotal moment occurred during the deposition of the investigating police officer. Michael Darling of the Falcon Law Group presented video footage and other evidence that the delivery company had not provided during the original crash investigation. After reviewing the previously unavailable evidence, the officer changed his opinion regarding responsibility for the collision.
"What makes this case particularly troubling is that the company had footage that could have helped explain what happened from the very beginning," said Joe Lopez, founder of Joe Lopez Law. "Instead, our client spent more than a year being blamed for a crash. When we finally put that evidence in front of the investigating officer, even he changed his opinion about who was responsible."
The implications extend beyond this single case. Commercial delivery vehicles can generate extensive electronic information, including onboard camera footage, vehicle tracking data, and driver activity records. Such evidence is often not available to injured motorists or even investigating authorities, creating a significant power imbalance. The case illustrates how corporations may withhold material that could clarify fault, leaving injured parties to fight against a well-resourced opponent.
"When you're going up against a billion-dollar company, you cannot simply accept its version of events," Lopez said. "You have to dig into the evidence, question the witnesses and be prepared to challenge the narrative. That's what we did, and ultimately we secured a $7.5 million settlement for our client."
The settlement conclusively resolves the client's injury claims. It also serves as a warning to commercial carriers that independent legal representation can uncover withheld evidence and alter the course of a case. For injured individuals and their families, the outcome reinforces the value of retaining counsel capable of aggressively pursuing electronic discovery in collisions involving large delivery fleets.
